TERMS OF SERVICE

  1. BUS
    1. ROLE OF REDBUS
      1. redBus only provides a technology platform that connects intending travelers with bus operators. It doesn’t operate any bus or offer the service of transportation to the User. redBus also doesn’t act as an agent of any bus operator in the process of providing the above-mentioned technology platform services.
      2. The bus ticket booking voucher which redBus issues to a User is solely based on the information provided or updated by the bus operator regarding the seat availability.
      3. The amenities, services, routes, fares, schedule, bus type, seat availability and any other details pertaining to the bus service are provided by the respective bus operator and redBus has no control over such information provided by the bus operator.
    2. LIMITATION OF LIABILITY OF REDBUS

      In its role as a technology platform to facilitate transactions between the bus operators and the Users, redBus shall not be responsible for the operations of the bus operator including, but not limited to the following:

      1. Timely departure or arrival of the bus;
      2. The conduct of bus operator's employees, representatives or agents;
      3. The condition of the bus, seats etc. not being up to the customer's expectation or as per the description provided by the bus operator;
      4. Cancellation of the trip due to any reasons;
      5. Loss or damage of the baggage of the customer;
      6. The bus operator changing a customer's seat for any reason whatsoever;
      7. Bus operator informing a wrong boarding point for the issuance of the booking confirmation voucher, or changing such boarding point eventually with or without any notification to redBus or the User;
      8. Bus operator using a separate pick-up vehicle to transport the User from the designated boarding point to the actual place of departure of the bus.
    3. RESPONSIBILITIES OF THE USERS
      1. Users are advised to call the bus operator to find out the exact boarding point, or any information which they may need for the purpose of boarding or travel in that trip.
      2. At the time of boarding the bus, Users shall furnish a copy of the ticket, and any valid identity proof like aadhar card, passport, PAN card or voter identification card or any other identity proof issued by a government authority.
      3. Users are required to reach the boarding place at least 30 minutes before the scheduled departure time.
      4. All tickets issued shall be non-transferable.
    4. CANCELLATION OF TICKET
      1. Cancellation of tickets can be done either through the User’s login in the redBus’s website or mobile application, or by calling on the customer care number;
      2. Any cancellation is subject to such cancellation charges as mentioned on the ticket.
      3. User needs to compulsorily obtain a bus ticket at the regular fare in case a child above the age of 5 years is accompanied by them, unless otherwise a particular bus operator specifies otherwise in their terms and conditions.
  2. HOTELS
    1. ROLE OF REDBUS AND LIMITATION OF LIABILITY OF REDBUS
      1. redBus acts as a facilitator and merely provides an online platform to the User to select and book a particular hotel. Hotels in this context includes all categories of accommodations such as hotels, home-stays, bed and breakfast stays, farm-houses and any other alternate accommodations.
      2. All the information pertaining to the hotel including the category of the hotel, images, room type, amenities and facilities available at the hotel are as per the information provided by the hotel to redBus. This information is for reference only. Any discrepancy that may exist between the website pictures and actual settings of the hotel shall be raised by the User with the hotel directly, and shall be resolved between the User and hotel. redBus will have no responsibility in that process of resolution, and shall not take any liability for such discrepancies.
    2. INFORMATION FROM THE HOTEL AND THE TERMS OF THE HOTEL
      1. The hotel booking voucher which redBus issues to a User is solely based on the information provided or updated by the hotel regarding the inventory availability. In no circumstances can redBus be held liable for failure on part of a hotel to accommodate the User with a confirmed booking, the standard of service or any insufficiency in the services, or any other service related issues at the hotel. The liability of redBus in case of denial of check-in by a hotel for any reason what-so-ever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of redBus (subject to availability at that time), or refunding the booking amount (to the extent paid) to the User. Any other service related issues should be directly resolved by the User with the hotel.
      2. Hotels reserves the sole right of admission and redBus has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests. redBus will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of redBus. No refund would be applicable in case the hotel denies check-in under such circumstances.
    3. RESPONSIBILITIES OF THE USER
      1. The User would be liable to make good any damage(s) caused by any act of him/ her/ or their accompanying guests (willful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. redBus would not, in any way, intervene in the same.
      2. The primary guest must be at least 18 years old to be able to check into the hotel.
      3. The User has to be in possession of a valid identity proof and address proof, at the time of check-in. The hotel shall be within its rights to deny check-in to a User if a valid identity proof is not presented at the time of check-in.
      4. Check-in time, check-out time, and any changes in those timings, will be as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel may charge an additional fee for providing such services.
    4. ADDITIONAL CHARGES BY THE HOTEL
      1. The booking amount paid by the User is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the User at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the User directly to the hotel.
      2. Hotels may charge a mandatory meal surcharge on festive periods like Christmas, New Year's Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel. redBus will have no control over waiving the same.
    5. PAYMENT FOR BOOKINGS AND ANY ADDITIONAL PAYMENTS
      1. Booking of a hotel can either be “Prepaid”, or “Pay at hotel” as per the options made available by a hotel on the Website of redBus.
      2. In “Prepaid” model, the total booking amount is paid by the User at the time of booking itself. Such total booking amount includes the hotel reservation rate, taxes, service fees as may be charged on behalf of the actual service provider, and any additional booking fee or convenience fee charged by redBus.
      3. At the hotel’s or redBus’s sole discretion on case to case basis, the User may also be provided with an option to make a part payment to redBus at the time of confirmation of a booking. The balance booking amount shall be paid as per the terms of the bookings.
      4. For security purposes, the User must provide redBus with correct credit or debit card details. redBus may cancel the booking at its sole discretion in case such bank or credit card details as provided by the User are found incorrect.
      5. Payment can be made either in INR or any other foreign exchange/currency as specified at the time of booking.
      6. Some banks and card issuing companies charge their account holders a transaction fee when the card issuer and the merchant location (as defined by the card brand, e.g. Visa, MasterCard, American Express) are in different countries. If a User has any questions about the fees or any exchange rate applied, they may contact their bank or the card issuing company through which payment was made.
      7. Some accommodation suppliers may require User and/or the other persons, on behalf of whom the booking is made, to present a credit card or cash deposit upon check-in to cover additional expenses that may be incurred during their stay. Such deposit is unrelated to any payment received by redBus and solely at the behest of the Hotel.
  3. RPOOL

    rPool is a feature on the redBus website that connects people who travel by road on a common route where one of such travelers uses empty seats of his private vehicle to offer ride to other traveler on the same route. The purpose of rPool is to promote pooling of vehicles (car or bike as the case may be ) between individuals commuting using their private vehicles so as to reduce traffic and work towards the greater cause of reducing pollution.

    1. GENERAL TERMS:
      1. ‘User’ shall have the same meaning as provided under the User Agreement including Driver and Rider as defined in the following clauses.
      2. ‘Driver’ refers to a User who offers his/her private vehicle for carpool/bikepool.
      3. ‘Rider’ refers to a User who avails the carpool/bikepool service being offered by a Driver.
      4. ‘Trip’ refers to a ride provided by a Driver or utilized by a Rider as per the terms mentioned under hereunder.
      5. ‘rPool Money’ refers to amounts credited to a Driver from a Rider for a given Trip. rPool earned cannot be used or redeemed except as provided in this Terms of Service.
      6. ‘rPool Wallet’ refers to online account provided by redBus to each of its User(s) to pay or receive rPool Money for a given Trip.
      7. redBus reserves its rights to amend the Terms of Service, at any time, by updating the amended terms on the Website.
    2. ROLE OF REDBUS:
      1. rPool merely provides an online platform and connects a Rider with a Driver, travelling on the common coordinates or route. It allows User (Driver/ Rider) to carpool/ bikepool together as co-traveler for non-commercial purpose and such trips taken by such co-travelers shall be construed neither to offer a “hire” by the Rider nor a “reward” to the Driver in any manner.
      2. rPool is neither to be considered as transportation carrier nor provider of service of transportation of any form or manner.
      3. rPool doesn’t guarantee the delivery of service between a Driver and a Rider. It is the sole discretion of Driver to decide whether to offer a Trip to a Rider or not.
      4. Booking a ride through rPool does not constitute a commercial relationship between the User and Rpool.
      5. redBus or rPool has no role in deciding the route of a Trip and destination cost, same is pre-determined and mutually agreed between a Driver and a Rider.
      6. rPool shall not be liable qua the information provided by a Driver or a Rider. Neither shall rPool be liable with respect to quality of the vehicle or any other factors with respect to the Ride.
    3. USER OBLIGATIONS:

        Users agree that:

      1. They will always abide by the terms mentioned under the instant Terms of Service. Any breach will lead to suspension of User account with immediate effect.
      2. They will not indulge during the course of the trip into any activity which is illegal and is in violation of any law of India.
      3. Both Driver and Rider shall be responsible for their acts and behavior towards each other and any disputes arising out of rPool between the Driver and the Rider shall be dealt independently by them.
      4. They shall provide sufficient proof of identity to the other User whenever sought by them in addition to that available through rPool.
      5. They shall reach the mutually agreed meeting point on the agreed time. In case, if any User fails to adhere the same, the other User shall have the right to cancel the Trip without any extra cost or liability.
      6. They shall not discriminate or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation.
      7. User agrees that insurance, if any provided as a part of the service or product by redBus shall be as per the terms and conditions of the third-party insurance company. redBus merely acts as a facilitator in connecting the User with insurance company. The User shall contact the insurance company directly for any claims or disputes. redBus shall not be held liable in case of partial acceptance or denial of the claims by the insurance company.
    4. OBLIGATIONS OF A DRIVER:
      1. Driver should (a) have a valid driving license and other necessary documents/ licenses issued by the appropriate authority in India, (b) follow all traffic rules and regulations of the respective state/ union territory, (c) use only a private vehicle owned by him or which is authorized to be used by him, (d) ensure that the vehicle is in proper working condition and adequate / appropriate insurance policies are obtained for the vehicle, its users and other relevant third parties.
      2. Driver to enroll himself /herself as User must submit to redBus all necessary documents including driving license, RC, insurance etc. along with any other relevant document required for KYC purpose while enrolling for rPool.
      3. Driver shall not provide the Trip for the purpose of hire or reward, non-compliance of which may cause delisting the him from rPool and also other penal actions under applicable laws.
      4. The Driver shall not charge any amount directly from the Rider, he will be entitled to the rPool Money as may be applicable for each Trip. The aforesaid rPool Money are designed to cover only the proportionate costs that may be incurred by a Driver for each Trip and to encourage commuters to car-pool for the larger benefit of reducing pollution.
      5. The Driver shall keep all necessary documents including but not limited to driving license, RC, insurance, pollution under control certificate etc. in the vehicle at the time of the Trip. Driver also undertakes to present the same to the Rider if a Rider shows an intent to verify the same.
      6. The Driver will be solely responsible as owner and driver of the vehicle in its individual capacity and in such capacity shall bear all liabilities which may result due to operation of the vehicle during such Trip, including but not limited any legal liability, accidents, physical injuries or death etc.
      7. Driver will use the only vehicle that has been registered with rPool and shall not offer a ride in the vehicle to any other unverified person while a Rider is on board.
      8. Each Driver is entitled to a maximum of 4 trips daily.
      9. Driver may take up to maximum of 4 Riders and 1Rider in case of car pool and bikepool respectively. However, the Driver is at liberty to offer a Trip to less than the limit mentioned herein.
      10. Driver shall report in the event:
        1. the Rider is different from the one enlisted for pickup.
        2. of any suspicious behavior by any of the Rider.
        3. Rider violates any law laid down by central or state government.
      11. The Driver shall always obey the traffic rules, speed restrictions while driving the vehicle to ensure safe rider for himself and the Rider(s). Any Driver who is found to be violating the traffic rules or speed restrictions, driving in inebriated state or under the influence of alcohol, or misbehaving with the Riders, shall be delisted from rPool by redBus without prejudice to any other legal remedies redBus may have.
    5. OBLIGATIONS OF A RIDER
      1. Rider shall upload and submit all the documents prescribed for KYC check while registering for rPool.
      2. Before riding on the vehicle, Rider will be fully responsible to verify the details of the vehicle and the Rider as per the details received from rPool upon successful booking of the ride. Rider will not make any payment whether in cash or in kind, though as compensation for the running cost of the vehicle and for the service availed by the Rider, certain amount of rPool Money shall be automatically deducted from the wallet of Rider and will be credited to the wallet of Driver, immediately upon the completion of trip.
      3. Rider shall respect the Driver, and treat the Driver’s vehicle or any other property of the Driver with due care and diligence and will be responsible for the loss or damage to the vehicle, Driver or any other person or property that may result out of his behavior or action while on board.
      4. Rider shall immediately report to redBus in case of any of the below events so as to enable red Bus take appropriate action :
        1. If the pick up is offered by any vehicle or person details of which does not match with the information received from rPool upon successful booking of ride;
        2. If Driver violates any traffic rules, any other laws;
        3. If Driver demands any payment or other compensation from him.
        4. If there is any other person already present in the vehicle other than as reflected at the time of booking or the Driver gives a ride to any other unverified person during the trip.
      5. Rider shall cooperate with Driver in obeying the traffic rules and / or speed restrictions while utilizing the ride. Any Rider who is found to be taking a ride in an inebriated state or under the influence of alcohol, or misbehaving with the Driver or other co-Riders, shall be delisted from rPool by redBus without prejudice to any other legal remedies redBus may have.
    6. PRICING AND PAYMENT TERMS
      1. In rPool certain amount is exchanged between the Driver and the Rider for a given Trip basis the rPool Money agreed upon between both Driver and Rider for the distance travelled.
      2. rPool has a capping on fixation of maximum rPool Money for every kilometer to be travelled on a given Trip. The maximum rPool Money that can be charged by a Driver from a Rider is as follows:

        However, the Driver is at liberty to offer a Trip at lowers points than mentioned above.
      3. redBus currently does not charge any fee from either the Rider or the Driver the User(s) of rPool, however, it may start charging a service fee from the User(s) in future to cover operational expenditure.
      4. Cash payment is strictly prohibited. Neither Driver(s) nor Rider(s) are permitted to make or accept payments in cash under any circumstances.
      5. Rider shall be under obligation to recharge its rPool Wallet so that it has sufficient balance to cover the cost of the ride which will be transferred to the rPool Wallet of the Driver at the end of the trip. As a process, at the end of each Trip, rPool Wallet of a Rider will be automatically debited with the Money for that Trip and be credited to the Driver’s rPool Wallet.
      6. For any payment or other related issues, User may write to us at rPool@redBus.in. The rPool Money earned by the Driver cannot be withdrawn as cash or to a bank account.
      7. The Driver can however redeem the same for vouchers of redBus or any entity with which redBus may enter into a business tie-up. The details of those tie-ups will be communicated by redBus from time to time through its website or to the Drivers over email; or
      8. Donate the rPool Money to MakeMyTrip Foundation. MakeMyTrip Foundation is a public charitable trust setup with an aim to work towards sustainable tourism while encouraging responsible tourism, ensuring environmental sustainability and undertaking projects towards restoration and development.
      9. The promotional/bonus rPool Money credited to any User’s rPool Wallet will be strictly for the purposes of availing carpool/bikepool services on redBus. User will not be allowed to redeem for purchase of any goods or services from any other merchant or seek refund of these rPool Money by withdrawing cash.
    7. LIMITATION OF LIABILITY:
      1. rPool merely provides a platform to Riders and Drivers to connect with each other for a private carpool/bikepool service and is not liable for any loss or damage that the User may incur while availing or providing the same.
      2. Though the Driver(s) and Rider(s) while registering on rPool go through a KYC process, they are also required to perform due diligence to ensure that the information provided on rPool matches a Driver or a Rider.
      3. User shall indemnify redBus against any such loss, damage, claims etc. that may be incurred by redBus due to the acts or omission of a User.
  4. TOURS & PACKAGES
    1. DEFINITIONS
      1. “Independent Contractors” means hotelier or hotel owner, owner of any airlines or shipping company or railway, ferryboat owner, coach owner, or any other person or organization which has been selected to render services to the User.
      2. “Package” means a Fixed Departure, Group or customized tour operated by redBus or other tour operators including but not restricted to private operators, government tourism development corporations and religious boards and includes, but is not limited to, brochure tours, special tours, pilgrim packages, cruise, sightseeing, carnival, cosmos, star cruise etc.
      3. “Tour Cost” means total booking cost of all the services booked by the User for his outbound tour.
      4. “Booking Fees” means a non-refundable fee or token money deposited at the time of booking by the User.
      5. “Brochure” means catalogue, leaflet, e-mail or any other document containing the details about the itinerary and activities on an outbound tour.
      6. “Infant” means a person below the age of 2 years and child means a person above the age of 2 years and below the age of 12 years.
    2. ROLE OF REDBUS AND LIMITATION OF LIABILITY
      1. redBus does not control or operate any airline, shipping company, coach, hotel, transport vehicles, restaurant, kitchen caravan or any other facility or service mentioned in the Brochure.
      2. redBus shall not be responsible for any delay, improper service, standard of service provided by any service provider or any Independent Contractor, or for any injury, death, loss or damage which is caused by the act or default of any hotel, airlines, shipping companies, cruise, coach owners, tour operators who are redBus's independent contractors.
      3. redBus shall not be responsible for any act or actions of co-travelers, co-passengers which may result in injury, damage to the life or limb or property of the User, or which may lead to interference in enjoying or availing the services provided on the outbound tour.
      4. Correct information of the contact details of the User shall be provided at the time of booking. redBus takes no responsibility for any claims arising out of non-receipt of information if the specified contact number is not reachable or does not belong to the User.
      5. redBus being merely a facilitator , shall not be liable for the following:
        1. Personal injury, sickness, accident, death, loss, delay, discomfort, increased expenses, incidental, consequential loss and/or damage or any kind of theft howsoever caused to the User or any person travelling with them.
        2. Any act, omission, default of any travel agent or third party or any other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the User or for any person traveling with him /her.
        3. The temporary or permanent loss of, or damage to, baggage or personal belongings howsoever caused including willful negligence on the part of any person.
        4. Any delay made in delivery of the service by the concerned service providers.
        5. Failure on the part of airline to accommodate passengers despite having confirmed tickets for any reason whatsoever including overbooking, change of route etc. or failure on part of hotel to allow check-in despite confirmed booking for whatever reason.
        6. Any claims of any dispute with the tour manager.
        7. Any claim arising due to delay at the pickup points and if the User has to wait at such pickup points or at the hotel for check-in due to any technical snag or any other reason not attributable to redBus, redBus shall not be liable for making any arrangements, including but not limited to food or any hotel arrangement in case of such delays.
        8. Any damages caused to the User due to reasons beyond the control of redBus.
      6. In no event shall the entire liability of redBus for any claims directly and indirectly arising out of the tour exceed the total booking amount paid by the User.
      7. There can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labor unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If redBus is informed in advance of such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to its User or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The User agrees that redBus being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. The maximum liability of redBus in such events will be to refund the booking amount subject to receipt from the service providers.
    3. BROCHURE
      1. All information given in the Brochure is based on the information available at the time of publication. redBus reserves the right to change any information contained in the Brochure before or after booking the outbound tour due to any event(s) beyond the control of redBus.
      2. The prices quoted in the brochure will be calculated at the time of publication and are subject to change redBus reserves the right to amend the prices published in the brochure in case of, changes in fuel costs, special/ high season charge levied by the suppliers, hike in the airline/ rail charges before the date of departure. All such increases in price must be paid for in full before the departure by the User.
      3. In case redBus becomes aware of any change before the departure for the Tour, redBus will take all reasonable steps to notify the User before the departure for that Tour. In the event of redBus becoming aware of the changes post the departure for the Tour, the redBus tour manager or local representative will inform the User about the change.
      4. Apart from the instant Terms of Service and the User Agreement, some specific terms and conditions are mentioned against the respective Tour in the Website as well as email communication and confirmed booking vouchers. Those terms and conditions also form part of the redBus User Agreement & Terms Of Service and are to be read in together and in consonance with each other.
      5. No claim of the User against any change in the Brochure regarding the Tour shall be entertained if such changes are due to reasons beyond the control of redBus.
    4. MEALS AND SPECIAL REQUESTS
      1. The menus are pre-set for meals on the Tour. The nature of meals is clearly indicated in the Brochure. redBus would not entertain a request for a special meal nor guarantees a special diet to the User except to the extent mentioned in the brochure.
      2. redBus reserves the right to change the menu if circumstances necessitate such a change. In the event that the User is not able to avail the meals in the menu for any reason, no claim can be made for the unutilized meal against redBus.
      3. User acknowledges that hotels serve breakfast at different time or time as specified in the confirmed booking voucher. User understands that Hotels do not pack or room deliver breakfast. The meal has to be consumed when served. If the User misses breakfast due to any reason, no claim for the same shall be entertained.
      4. redBus may, in its sole discretion, entertain the requests for such special meals, room allocations or any other request subject to such requests being honored by respective service providers. redBus would take all the necessary steps to ensure that these special requests are honored. However, in the event that such special requests are not honored, redBus would not be liable for any claim in this regard by the User. Extra cost, if any, for special meals or any such special requests have to be borne by the User.
      5. If the User fails to avail the meal or any other special request due to any reason whatsoever, then redBus's liability is limited to proportionate amount that the User had paid redBus for the meal while booking the outbound tour.
    5. HOTELS IN THE TOUR
      1. redBus takes all reasonable steps at the time of selecting the hotels that form a part of the Tour. The selection is based on an internal assessment of the respective hotels and such hotels selected are usually the best in the respective categories. redBus endeavors to provide details of the hotel to the User in advance vide proposed itinerary. However, redBus reserves the right to change hotels before booking, subject to availability or any other reason beyond its control.
      2. Once the User opts for a certain category or star rating of a hotel, later no claim with regard to the star category or type of the hotel shall be entertained by redBus. redBus would not be held liable or to make good any inconvenience or discomfort caused to the User due to but not limited to the insufficient services provided at the hotel. redBus acts as a facilitator between the User and the hotel, and would under no circumstances be held responsible for inadequate services provided by the hotel.
      3. The User would be liable to make good any damage(s) caused by any act of him/her or their accompanying guests to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. redBus would not, in any way, intervene in the same.
      4. No request for the change of hotel shall be entertained after the booking is confirmed. If User upgrades the hotel or changes the hotel on his own, he/she agrees to bear the charges incurred for change in the hotel and shall not be entitled to claim it from redBus.
      5. User shall be responsible for his/ her baggage and valuables. redBus shall not be liable for any loss of baggage or theft of User's articles during their stay in the hotels or any time during the tour.
    6. ITINERARY
      1. redBus will provide a proposed itinerary to the User before the booking. Such proposed itinerary shall be subject to changes. The confirmed booking details and hotel vouchers sent to the User before departure and after payment of entire booking amount shall be final.
      2. The Tour price is subject to increase without any prior notice. In case of any change in the price prior to departure, the User would be required to pay such incremental tour cost before the departure.
      3. The days and nights of the itinerary are decided as per the availability of hotels and airlines. No claims regarding full utilization of last day or inclusion in the tour shall be valid.
      4. redBus takes all reasonable steps at the time of finalizing the itinerary for the User to ensure that the itinerary is as per the convenience and comfort of the User. However, in the event of a change in the itinerary, redBus would inform the User accordingly before the departure of the User on the Outbound Tour.
      5. Further, in the event of any change beyond the control of redBus in the itinerary of the User post departure for tour, redBus shall inform the User accordingly as and when such a change occurs. redBus shall not be held responsible in any manner whatsoever for any loss that a User might suffer consequent to such a change.
      6. redBus reserves the right to claim any additional expenses on account of delays or changes in the itinerary, for reasons beyond its control.
      7. redBus reserves the right to amend, alter, vary or withdraw any particular departure, excursion or substitute a hotel of similar category, or any other aspect of the itinerary, if deemed advisable or necessary.
      8. In the event that the User misses out on any activity which forma a part of the tour due to delay on his part, redBus would not be held liable to refund the money paid for the same.
      9. redBus will not entertain any change in the itinerary at the request of the User after booking, as such change might disarray the entire tour. However, redBus may, in its sole discretion and subject to availability, provide changes in the itinerary made at the request of the User. User agrees to pay additional cost incurred due to such change/cancellation.
    7. COACH AND SITTING
      1. Coaches (including cabs, buses etc.)are used for transfer purposes including but not limited to intercity travel, local transport within city and local sightseeing. There may / may not be seat numbers allocated depending upon the itinerary allocated and the Users shall follow instructions of the Tour Manager in this regard.
      2. In case the User is carrying any valuable personal belongings, it is advisable not to leave them behind at the time of disembarking or leaving the coach. redBus will not be held responsible or liable in case of loss of such items from the coach. All baggage and personal effects are at all times and in all circumstances the responsibility of the User.
      3. Any damage caused to the coach during travel as a consequence of the actions of the User shall be payable by the User and redBus would in no manner whatsoever be liable for the same.
      4. The drivers of the coaches are bound by specific rules like maximum driving hours within a day/ during a week, rest period per day/ week etc. Users will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel. In the event that any of the sightseeing schedules is missed due to delays caused by the User, the cost of same will not be refunded to the User under any circumstances.
      5. In the event of breakdown of any coach or any vehicle arranged for transportation, redBus will provide an alternative within reasonable time. redBus shall not be liable for any delays occurred due to such breakdown or traffic jam or for any reasons causing delay in the provision of alternative coach or vehicle.
    8. ACCOMMODATION FOR CHILD BELOW 12 YEAR OF AGE
      1. If a child below 12 years of age is booked on the tour without paying for a separate bed, then no separate bed will be provided in the hotel.
    9. BOOKINGS THROUGH THIRD PARTY/ TRAVEL AGENTS
      1. If the User books with a travel agent, the contract is with the User's travel agent and redBus is a supplier to the User's travel agent.
      2. redBus takes no liability for any promises made to the User by any other travel agent authorized by the User to make bookings. All products and services are provided as per redBus Brochures or any other document provided to the User at the time of booking the tour.
      3. In case of bookings through other travel agents, refunds (if any) will be made to the travel agent authorized by the User to make bookings.
    10. FORFEITURE OF DEPOSITS
      1. redBus may require the User to pay non-refundable interest-free booking fee at the time of booking the tour.
      2. In the event that the User cancels the booking or fails to adhere to the tour payment schedule as informed in the documentation check list or the User is unable to travel on the tour booked due to any personal reason, including medical ground or sickness, cancellation charges will apply as communicated to the User by redBus.
      3. User acknowledges that booking of travel tickets, hotels for a tour is done parallel to visa processing, wherever applicable, to ensure the availability as per the proposed itinerary. In the event of any denial or rejection of visa, redBus shall be entitled to recover any cost incurred in making such bookings by way of deducting cancellation charges as specified hereinabove. User acknowledges that such charges are just and fair and are deducted towards expenses that redBus incurs towards making bookings at the request of the User and consequent cancellation or non-travel by the User.
    11. CANCELLATION CHARGES

      If the Tour is cancelled for any reason what-so-ever, including cases of voluntary cancellation by the User, the cancellation charges as mentioned in the brochure or the itinerary will apply. In the absence of any such information, the following cancellation charges will apply:

      Time period in which the cancellation is made Charges

      Between 44 and 31 days of departure 25% of Tour Cost
      Between 30 and 15 days of departure 50% of Tour Cost
      Between 14 and 8 days of departure 75% of Tour Cost
      Within 7days prior to date of departure, or no-show for any reason what-so-ever 100% of Tour Cost
    12. PAYMENT OF THE TOUR COST
      1. Payment shall be made as per the payment schedule provided on the brochure, Email or any other documented information as informed at the time of booking.
      2. Payment can be made either online or by way of DD/cheque as specified to the User which may vary based on the tour.
      3. If any cheque towards the payment is dishonored, redBus, without notice to the User, shall be entitled to cancel the entire booking without any liability and take recourse to appropriate legal remedy.
      4. Final Tour booking vouchers and documents will be shared with the User only after the complete payment is made to redBus by the User. PAN Card copy will be required when payments amounting to Rs.25,000/- or above are made by cash.
      5. redBus will only provide a consolidated invoice of the entire tour cost. redBus is not obligated in any circumstance to provide break–up of the invoice for each of the service included in the package.
      6. A transfer from one tour to another prior to the departure of the originally booked tour will be treated as a cancellation of the original tour and would attract the cancellation charges as stated hereunder and a fresh booking would have to be made at the prevalent rates.
    13. REFUNDS
      1. redBus is only a facilitator and any refund for any service(s) which are not delivered by the service provider /Independent Contractors or for any reason for which the User is entitled for a refund is subject to redBus receiving the amount from the said service provider. User acknowledges that redBus shall not be held liable for any delay in refund or non-refund of the amount from the respective service provider or Independent Contractors of redBus. In such events the User shall directly approach the service provider for any claims.
      2. In case the User makes any changes in their accommodation while on the Tour, redBus shall not refund or pay compensation in any manner whatsoever. The User would also be liable to pay any additional sum that is required to be paid consequent to the aforesaid changes made in the accommodation.
      3. In the event of any delay in the refund beyond the period specified herein, the entire liability of redBus shall be refund of the said amount with interest calculated at the applicable bank rate till the date the refund is made.
    14. AMENDMENTS
      1. In the event of redBus amends or alters any tour or holiday after such a tour or holiday has been booked, the User shall have the option to continue with the tour or holiday as amended/ altered, or to accept any alternative tour or holiday which redBus may offer.
      2. In either of these cases above, the User shall not be entitled to nor redBus be liable to the User for any damage, additional expenses or consequential loss suffered by the User. redBus’s liability in such cases shall be only to refund the amount of the cost of the said tour to the User (after deducting applicable cancellation charges, and other overheads as applicable from case to case, without any interest on the same.
    15. PROMOTION & DISCOUNTS
      1. redBus may, from time to time, launch some promotions and discount offers on the tour package internally or externally through advertisements and some Users might receive additional benefits due to entitlement to such promotion and discounts. No claims from other Users booking a similar tour or package for such privileges shall lie if they are not entitled for the discounts or eligible under the promotion.
      2. In case of publication of any travel scheme offering any discount or benefit by redBus, redBus shall have the sole right to withdraw such a scheme or discount at any time.
    16. TOUR ARRANGEMENTS & OTHER ACTIVITIES
      1. For tour arrangements like temple darshan, amusement parks, museums etc., the terms and conditions specified by such respective entities shall also be applicable.
      2. It shall be the responsibility of the User to reach the place of commencement of the tour and register with the representative of redBus/ tour guide/ tour manager at the appointed place, date and time.
      3. Any additional fee viz. entry fees, VIP entry has to be borne by the User himself and paid directly to the concerned entity.
      4. If a User avails pre-tour services or part thereof, or the Travel tickets (cost of which is included in the main tour cost) but fails to join the group for the main tour at the appointed place, or cancels the tour after using the Travel tickets or pre-tour arrangements or part thereof, it shall be treated as "no show" and there will be no refund whatsoever for the unutilized pre-tour or main tour services.
      5. redBus reserves the right to withdraw tour membership of any User whose behavior is deemed likely to affect the smooth operation of the outbound tour or adversely affect the enjoyment or safety of other passengers. redBus shall not be liable for any damages due to such withdrawal.
  5. BUSHIRE
    1. ROLE OF REDBUS
      1. redBus only provides a technology platform that connects intending travelers with operators to hire an entire vehicle. It doesn’t operate any vehicle or offer the service of transportation to the User. Instead fulfilment of these bookings is done by operators who are empanelled with redBus. redBus also doesn’t act as an agent of any operator in the process of providing the above-mentioned technology platform services.
      2. The Vehicle booking voucher which redBus issues to a User is solely based on the information provided or updated by the vehicle operator.
      3. The amenities, services, fares, routes, schedule, bus type and any other details pertaining to the bus service are provided by the respective vehicle operator and redBus has no control over such information provided by the bus operator or fulfillment of the same.
    2. LIMITATION OF LIABILITY OF REDBUS

        In its role as a technology platform to facilitate transactions between the bus operators and the Users. Under no circumstances can redBus be held liable for failure on part of a service provider to provide the User with a particular Bus, the standard of service or any insufficiency in the services or any other service related issues including, but not limited to the following:

      1. Timely departure or arrival of the vehicle;
      2. The conduct of bus operator's employees, representatives or agents;
      3. The condition of the vehicle, seats etc. not being up to the customer's expectation or as per the description provided by the bus operator;
      4. Cancellation of the trip by the vehicle operator due to any reasons ;
      5. Loss or damage of the baggage of the customer;
      6. Bus operator using a separate pick-up vehicle to transport the User from the designated boarding point to the actual place of departure of the bus.
      7. In some cities, the customer may see the name of the operator of whom they are making a booking. In such cases, best effort shall be made to ensure that the same operator fulfils the booking. In other cities, where the customer sees only the vehicle type, redBus shall choose an operator from its panel to fulfil the booking.
      8. In cases of unavailability of the hired vehicle or where the bus breaks down during the journey, redBus may reach out to the concerned service provider to make arrangements for an alternate Bus of a similar standard. User may reach out to bushire.support@redbus.in for any assistance.
      9. It is the sole liability of the vehicle operator to obtain all the relevant licenses, permits etc. to undertake the travel booked. In case of any cancellation of booking owing to absence of necessary licenses or permits by the vehicle operator, redBus shall not be liable in any manner.
    3. RESPONSIBILITIES OF THE USERS
      1. Users are advised to call the vehicle operator to find out the exact boarding point, or any information which they may need for the purpose of boarding or travel in that trip.
      2. At the time of boarding the bus, Users shall furnish a copy of the confirmation booking voucher, and any valid identity proof issued by a government authority.
    4. CANCELLATION OF BOOKING
      1. Cancellation of bookings can be done either through the User’s login in the redBus’s website or mobile application, or by calling on the customer care number;
      2. Any cancellation is subject to such cancellation charges as mentioned on the booking details.
    5. PAYMENT FOR BOOKING AND ANY ADDITIONAL CHARGES
      1. FULL PAYMENT: Payment maybe made in full amount to redBus during the booking. Such total booking amount includes the base fare, applicable taxes including GST as may be applicable as per local laws, and any additional booking fee, service fee or convenience fee charged by redBus.
      2. PARTIAL PAYMENT: Under this option User has to make payment of a partial amount as specified at the time of booking / in the booking voucher and pay the balance amount within a specified time period as informed the time of booking / in the booking voucher. Failure to pay such balance amount within the stipulated time will lead to cancellation of the booking and any refund will be subject to the booking/ cancellation policy. In some cases, the customer may be allowed to make the balance payment at the start of the trip.
      3. PAY AT BUS: Under this option the User has to pay certain part of the booking amount specified at the time of booking / in the booking confirmation voucher to redBus and the balance to the vehicle operator at the start of the trip.
      4. Expenses like toll charges, permit charges, parking charges, entry fees, Service Tax & any other Government Tax as per Government guidelines are to be borne by the User and paid directly to the driver.
      5. The excess Driver Bata wherever applicable has to be paid directly to the driver.
      6. User may opt for Insurance while booking. Such Insurance will be provided entirely by third party and redBus in no way will be a party to any such claims or concerns on the matter.
  6. ACTIVITIES AND OTHER SERVICES
    1. DEFINITIONS
      1. ‘Activity’ includes day tours & sightseeing, spa & wellness, adventure sports, cruise, theme/ amusement parks, buffets & dining or any other service/product booked on the Website.
      2. The provider of the Activity will be referred as ‘Activity Provider’, who shall be solely responsible for provision of the products/ services booked by the User.
    2. ROLE OF REDBUS AND LIMITATION OF LIABILITY
      1. redBus’s role is limited to facilitating the procurement of an Activity service to the User from the concerned Activity Provider. The transaction or the service fulfilment relation is always between the User and the Activity Provider.
      2. redBus shall not provide pick up and drop facility for any Activity unless otherwise explicitly mentioned in the confirmation of the reservation.
      3. redBus shall not be liable or responsible for:
        1. Any damage or loss, injury, accident, death, breakdown, irregularity, delay/change in schedule, cancellation without cause, inaccurate information, deficiency of service/product, or cancellation due to conditions not under the control of Activity Provider;
        2. The health, safety and well-being of the User in the course of availing the Activity or thereafter;
        3. Any incidental or ancillary services which is directly purchased by the User from the Activity Provider;
        4. Any incorrect information provided by the Activity Provider.
      4. The maximum liability of redBus will be limited to refund of booking amount which was received by redBus for reservation of the Activity.
    3. RESPONSIBILITIES OF THE USERS
      1. The User agrees to comply with the terms and conditions of Activity Provider in addition to redBus’s User Agreement and Terms of Service.
      2. The User will be required to present the booking / confirmation voucher issued by redBus in order to avail the Activity.
      3. The User shall further be in possession of valid documents viz. identity proof, address proof, passport in case of Activity booked outside India or any other document as specified by the Activity Provider in order to utilize the Activity booked.
      4. The User may be required to sign a waiver/consent form, safety procedure form, medical declaration or other document before availing the Activity where mandated by the Activity Provider.
      5. The User shall reach out to Activity Provider directly for any concerns subsequent to the confirmation of reservation.
      6. The User should ensure that he qualifies all the eligibility criteria for availing the Activity including but not limited to age limit, weight limit, medical conditions etc. User understands that in case he is found unfit or illegible for the Activity, Activity provider may or may not allow the User to avail the said Activity.
    4. PAYMENTS FOR BOOKINGS, AND CANCELLATIONS
      1. Reservations will be subject to cancellation and refund policies of the Activity Provider which may vary from time to time.
      2. redBus may charge applicable taxes or service charge, convenience fees etc. wherever applicable.
    5. SPECIAL OFFERS AND COUPONS

        The following terms will additionally apply to any coupon provided by redBus:

      1. redBus’s responsibility is limited to sharing the coupon with the User subject to receipt of payment from the User;
      2. The redemption of coupon is User’s responsibility, and providing the service will be the Activity Provider’s responsibility;
      3. The expiry date of the coupon shall be mentioned on the coupon and the User will not be able the use the coupon subsequent to the date of expiry;
      4. The coupon is not redeemable for cash;
      5. The coupon once purchased cannot be refunded or cancelled.
